Converting commercial premises into a home in Almería

We tell you if a commercial unit can become a home before you buy it. Technical partner for funds and investors. Also for private buyers.

Requirements for converting commercial premises into a home in Almería Units that look like opportunities.

A commercial unit can be a good home or an expensive problem. The difference shows before buying, not after. It's decided by the PGOU (local land-use plan) and the Spanish Building Code (CTE). These are the points we check.

Do you need permission from the neighbours?

It depends on the building's bylaws and what the works involve. We check it before designing, because it can decide the deal.

01

Bylaws and title deed

If the bylaws or the deed of division expressly prohibit residential use in the commercial units, changing them requires unanimity. If they say nothing, there's no prohibition.

02

Works inside the unit

For works that don't affect the structure, façade, safety or other neighbours, it's enough to notify the owners' association before starting.

03

Façade and common elements

Opening windows, changing the shop front, or touching floor slabs, structure or downpipes requires the owners' meeting to agree, as well as the licence.

Licence and signature

Which procedure applies and who signs it

Converting a commercial unit into a home adds a dwelling to the building. That's why a responsible declaration isn't enough: a project and a licence are required.

Licence

A licence, not a responsible declaration

In Andalusia, a change of use via responsible declaration is only possible when the number of dwellings doesn't increase (Law 7/2021, art. 138). Going from commercial unit to home does increase it.

Project

Signed by an architect

In buildings for commercial or industrial use, the Spanish Supreme Court (ruling 700/2026) reserves the change-of-use-to-housing project for architects.

Without a licence

Real risk

Without a licence you can't register, deed, sell or rent the unit as a home, and the works can end in a fine and an obligation to restore the original use.

Who analyses it

Hi, I'm Belén

Chartered architect · COAA 8037 · COAM 22517 · 10+ years of experience

I run Berila.Studio, an architecture studio in Almería. I analyse each unit before it's bought, sign the change-of-use project and manage the works until it's a legal, well-resolved home.

Why us
  • Architect's signature. In buildings for commercial or industrial use, the change-of-use-to-housing project has to be signed by an architect. I sign it.
  • Feasibility before buying. I tell you if the unit can be a home before you sign. If there's no deal, we'll tell you plainly.
  • From analysis to works. Feasibility, project, licence and site management. Together or separately, depending on what you need.
How we work

How we analyse a commercial unit.

  1. Step 01

    You tell us the goal

Which unit or portfolio you're assessing, what for and on what timeline. Via the form or WhatsApp, no obligation.

  2. Step 02

    We review the property

Site visit or document review: plans, land registry extract and cadastre.

  3. Step 03

    We check feasibility

Planning, habitability and technical conditions. This is where we find out whether there's a deal.

  4. Step 04

    We put numbers on it

An estimate of the works cost and the final value, so you can decide with numbers.

  5. Step 05

    We define the strategy

If the deal goes ahead: layout, project, licence, works and schedule.

Before you decide

Change of use: frequently asked questions

Do you need a licence to convert commercial premises into a home?

+
Yes. The change of use requires a licence from Almería City Council and a technical project signed by a registered architect. Without it, the property can't be sold or rented as a home, and the works can end in a fine and an obligation to restore the original use.

How long does a change-of-use licence take in Almería?

+
Between 3 and 12 months of municipal processing, depending on the procedure and the council's workload. Before that, the technical project has to be drawn up and, afterwards, the works carried out and the completion certificate obtained.

Can you analyse several units or a whole portfolio?

+
Yes. We apply the same criteria to each asset (planning, habitability and cost) and give you a comparison to prioritise which ones to invest in.

Is it worth investing in a commercial unit to convert it into a home?

+
It depends on the purchase price, the real cost of the conversion and demand in the area. Some units are a good opportunity and others aren't worth it. Prior analysis is what separates them. If you already have a unit in mind and want a rough idea of whether it makes sense, you can start with the Strategy Session: 90 minutes, online.

Can the change of use be done with a responsible declaration?

+
No. In Andalusia, a responsible declaration only applies to changes of use that don't increase the number of dwellings. Converting a commercial unit into a home adds a dwelling to the building, so it needs a technical project and a municipal licence.

Do I need permission from the owners' association?

+
If the bylaws don't prohibit residential use and the works don't touch the façade or common elements, it's enough to notify the association. If you need to open windows, change the shop front or work on the structure, you need the owners' meeting to agree. If the bylaws expressly prohibit it, changing them requires unanimity.

Who can sign the change-of-use project?

+
In buildings for commercial or industrial use, the Spanish Supreme Court has ruled that the project must be signed by an architect. At Berila.Studio the project is signed by Belén Sola, a registered chartered architect.

What if the unit is already being used as a home without a licence?

+
It can be regularised by applying for the missing licence, as long as the unit complies with the PGOU and habitability conditions. If it doesn't, the unit will have to be adapted or you'll have to accept that it can't be a home.

What needs doing once the works are finished?

+
Completion certificate, responsible declaration of occupancy at the town hall, change-of-use deed before a notary, registration with the Land Registry and update in the Cadastre. Then, utilities as a home and the energy certificate if you're going to sell or rent.

Can a ground-floor unit with a single façade become a home?

+
It depends on the depth of the unit and the layout. The main rooms need daylight and ventilation from outside, so in very deep units that's usually the critical point. We check it on the plans before you buy.
